Business Owner Migration

There are three pathways towards permanent residency if you are an eligible business owner.

Pathway 1
State Sponsored Business Owner Provisional (4-year provisional) to Sponsored Permanent Visa

You or your partner must be under the age of 55 (unless you have an exceptional business proposal for Australia), You must own and operate a business which has AUD$300 000 turnover, have personal assets of AUD$500 000 combined and you must have a commitment to maintain an ownership interest in a business in Australia and be involved in the day-to-day management of that business.

State Sponsored Business Owner Provisional (4-year provisional) to Sponsored Permanent Visa

Age - You or your partner must be under the age of 55. If you are over the age of 55, you must have an exceptional business plan that will be of great benefit to the Australian economy, otherwise you will not qualify. If you are under the age of 45 Pathway 2 may also be any option for you.

Business Ownership - You have to own a business(s) that have an annual turnover of at least $300,000AUD. This turnover must be established for at least 2 years in the past 4 years of applying for this visa.

Business and Personal Assets -Your (and your partner's combined) business and personal assets have a net value of at least AUD500 000 and were legally acquired and are capable of being transferred to Australia within two years of being granted this visa.

Business Role - You must be engaged in managing and operating your business for more than 50% of your time. This means that if you are the principal doctor, dentist, electrician, or lawyer and are spending more than 50% of the time conducting the tasks and responsibilities of that profession, your application may be unsuccessful.

Business Career - You must demonstrate an overall successful business career which is legitimate and which can be evidenced. For example, cash turnover which has not been declared to your taxation department cannot be claimed.

Commitment to Business in Australia - You must have a commitment to maintain an ownership interest in a business in Australia and be involved in the day-to-day management of that business.

State or Territory Sponsorship - It will be necessary to choose a state of Australia you wish to come to and present your business background and business proposal for that region to that regional authority for their approval. As part of our service we can assist and prepare this Sponsorship application for you.

If you are under the age of 45, have good English language ability, higher turnover, and higher business and personal assets you may not require State or Territory Sponsorship and may qualify for an Independent Business Owner visa.

Health and Character Requirements - Everyone in the application must meet these requirements.

If all criteria above can be addressed you may be granted a 4-year provisional visa to Australia. During your 4 years in Australia you must commit to owning and operating a Business in Australia and meet the following criteria:

Business Ownership - You must have had and continue to have, an ownership interest and continuous management of a business(s) in Australia for at least two years immediately before you apply.

Annual Turnover - Your main business had a turnover of at least AUD$200 000 in the 12 months immediately before you apply. (There may be concessions to this if there are exceptional circumstances and your business and residence is located in a designated area of Australia)

Acceptable Business Record - You or your partner have never been involved in unacceptable business activities.

Time in Australia - You have been in Australia for at least 1 year cumulatively in the two years before you apply.

You can choose to meet any 2 of these 3 requirements:

1/ Net Business Assets - The net value of your (and partner combined) assets in your main business (or two main businesses) in Australia is at least AUD$75 000 throughout the 12 months immediately before you apply.

2/ Net Personal and Business Assets - The net value of your (and partner combined) personal and business assets in Australia has been at least AUD$250 000 throughout the 12 months immediately before you apply

3/ Provided Employment - Throughout the 12 months immediately before you apply, the business must have employed 1 full-time Australian citizen/permanent resident employee who is not a member of your family.

Health and Character Requirements - Everyone in the application must meet these requirements

Pathway 2
Independent Business Owner Provisional (4-year provisional) to Permanent Business Visa

You or your partner must be under the age of 45 and have vocational English. You must have net assets of AUD$200 000 in a qualifying business and its annual turnover must be least AUD$500,000. Your (and your partner's combined) business and personal assets must have a net value of at least AUD$500 000 and you must have a commitment to maintain an ownership interest in a business in Australia and be involved in the day-to-day management of that business.

Independent Business Owner Provisional (4-year provisional) to Permanent Business Visa

Age - You or your partner must be under the age of 45.

English Level - The main applicant must have a vocational level of English.

Business Assets - You (and your partner combined) has net assets of AUD$200 000 in a qualifying business for at least 2 years in the past 4 years before applying.

Business Turnover - You have to own a business that have an annual turnover of at least $500,000 AUD. This turnover must be established for at least 2 years in the past 4 years of applying for this visa.

Business and Personal Assets - Your (and your partner's combined) business and personal assets have a net value of at least AUD500 000 and were legally acquired and are capable of being transferred to Australia within two years of being granted this visa.

Business Career - You must demonstrate an overall successful business career which is legitimate and which can be evidenced. For example, cash turnover which has not been declared to your taxation department cannot be claimed.

If all criteria above can be addressed you may be granted a 4-year provisional visa to Australia. During your 4 years in Australia you must commit to owning and operating a Business in Australia and meet the following criteria:

Business Ownership - You must have had and continue to have, an ownership interest and continuous management of a business(s) in Australia for at least two years immediately before you apply.

Annual Turnover - Your main business had a turnover of at least AUD$300 000 in the 12 months immediately before you apply.

Net Business Assets - The net value of your (and partner combined) assets in your main business (or two main businesses) in Australia is at least AUD$100 000 throughout the 12 months immediately before you apply

Net Personal and Business Assets - The net value of your (and partner combined) personal and business assets in Australia has been at least AUD$250 000 throughout the 12 months immediately before you apply

Provided Employment - Throughout the 12 months immediately before you apply, the business must have employed 2 full-time Australian citizens/permanent residents employee who are not members of your family.

Acceptable Business Record - You or your partner have never been involved in unacceptable business activities.

Time in Australia - You have been in Australia for at least 1 year cumulatively in the two years before you apply.

Health and Character Requirements - Everyone in the application must meet these requirements

Pathway 3
Permanent Business Talent Visa

You must be under the age of 55 or have an exceptional business proposal for Australia). Your combined net business assets must be AUD$400 000 and the annual turnover of your business must be at least AUD$3 000 000. Your (and your partner's combined) business and personal assets must have a net value of at least AUD$1 500 000. You must demonstrate an overall successful business career which is legitimate and which can be evidenced. You must have a commitment to maintain an ownership interest in a business in Australia.

Permanent Business Talent Visa

Age - You must be under the age of 55. If you are over the age of 55, you must have an exceptional business plan that is determined to be of great benefit to the Australian economy by a regional authority, otherwise you will not qualify.

Business Assets - You (and your partner combined) have net assets of AUD$400 000 in a qualifying business for at least 2 years in the past 4 years before applying.

Business Turnover - You have to own a business that has an annual turnover of at least AUD$3 000 000. This turnover must be established for at least 2 years in the past 4 years of applying for this visa.

Business and Personal Assets -Your (and your partner's combined) business and personal assets have a net value of at least AUD$1 500 000 and were legally acquired and are capable of being transferred to Australia within two years of being granted this visa.
